The main aim of this article is to reflect on the impact of biases related to artificial intelligence (AI) systems developed to tackle issues arising from the COVID-19 pandemic, with special focus on those developed for triage and risk prediction. A secondary aim is to review assessment tools that have been developed to prevent biases in AI systems. In addition, we provide a conceptual clarification for some terms related to biases in this particular context. We focus mainly on nonracial biases (...) that may be less considered when addressing biases in AI systems in the existing literature. In the manuscript, we found that the existence of bias in AI systems used for COVID-19 can result in algorithmic justice and that the legal frameworks and strategies developed to prevent the apparition of bias have failed to adequately consider social determinants of health. Finally, we make some recommendations on how to include more diverse professional profiles in order to develop AI systems that increase the epistemic diversity needed to tackle AI biases during the COVID-19 pandemic and beyond. McDowell’s minimal empiricism holds that experience, understood as providing conceptually articulated contents, plays a role in the justification of our beliefs. We question this idea by contrasting the role of perceptual experience in moral and non-moral judgments and conclude that experience per se is irrelevant in the former case and should also be so in the latter one: only with the help of adequate beliefs experience can provide a connection with the world. nos últimos anos, John McDowell tem proposto uma concepção de filosofia em que o objetivo da disciplina não é oferecer teses substanciais, mas antes revelar modos de pensar e premissas ocultas que estão na base da filosofia construtiva. Esta visão terapêutica tem sido chamada ‘quietismo’ e deve muito a algumas idéias favoritas de Wittgenstein ao longo de toda a sua vida. No entanto, a obra de Wittgenstein (e, talvez, também a de McDowell) parece oscilar entre duas compreensões de quietismo: pode-se (...) ser quietista por não macular aquilo que é mais importante com discussões explícitas ou pode-se ser quietista por não ter nada a dizer. Argumentaremos que o segundo tipo do quietismo não implica recusar em se ocupar com a filosofia do passado, nem tampouco adotar uma atitude contemplativa. A concentração sobre o particular, em ética tanto quanto em qualquer outra área da filosofia, é suficiente para minar as ambições universalistas da filosofia tradicional e descortinar um aumento na ação filosófica. This paper argues that the normative character of our unreflective situated behaviour is not factual. We highlight a problematic assumption shared by the two most influential trends in contemporary philosophy of cognitive science, reductionism and enactivism. Our intentional, normative explanations are referential, descriptive or factual. Underneath this assumption lies the idea that only facts can make true or false our attributions of cognitive, mental and agential abilities. We will argue against this view by describing the main features and problems of (...) reductionism and enactivism and then we will offer two arguments against this shared factualist assumption: (1) normative vocabulary is ineliminable if we want a complete explanation of our situated practices; and (2) the factualist assumption is a species of the is-ought fallacy. Finally, we will claim that a folk psychological explanation of our normative practices is fully compatible with ontological naturalism when such descriptivist or factualist assumption is rejected. In this paper, we offer a criticism, inspired by Wittgenstein’s rule-following considerations, of the enactivist account of perception and action. We start by setting up a non-descriptivist naturalism regarding the mind and continue by defining enactivism and exploring its more attractive theoretical features. We then proceed to analyse its proposal to understand normativity non-socially. We argue that such a thesis is ultimately committed to the problematic idea that normative practices can be understood as private and factual. Finally, we offer a (...) characterization of normativity as an essentially social phenomenon and apply our criticisms to other approaches that share commitments with enactivism. (shrink)

In this paper we challenge the notion of ‘normativity’ used by some enactive approaches to cognition. We define some varieties of enactivism and their assumptions and make explicit the reasoning behind the co-emergence of individuality and normativity. Then we argue that appealing to dispositions for explaining some living processes can be more illuminating than claiming that all such processes are normative. For this purpose, we will present some considerations, inspired by Wittgenstein, regarding norm-establishing and norm-following and show that attributions of (...) normativity to non-social agents are deeply paradoxical. The main conclusions of our discussion are: (1) circular and internal explanations centred on the stability of living systems are insufficient to account for processes where the environment plays an important role, such as adaptation. Enactivism is not an explanatory alternative to evolutionary biology but needs it as a complement to accounts focused on the internal self-assembly of organisms; (2) though we share enactivism’s anti-representational spirit, we argue that ecological psychology can offer a better account of perception. Richard Moran has argued, convincingly, in favour of the idea that there must be more than one path to access our own mental contents. The existence of those routes, one first-personal—through avowal—the other third-personal—no different to the one used to ascribe mental states to other people and to interpret their actions—is intimately connected to our capacity to respond to norms. Moran’s account allows for conflicts between first personal and third personal authorities over my own beliefs; this enable some instances of (...) Moore-paradoxical cases to be meaningful. In this paper we reflect on the consequences of this view for the acquisition of beliefs, and argue that, as in the moral case, excessive concentration on a thirdpersonal understanding of thought undermines the very idea of being directed to the world and of being capable to fully own our own beliefs. We suggest that maybe too much attention to epistemic virtues or tojustification is misdirected and could produce beliefs that are themself not first-personal enough. (shrink)

Or, les institutions publiques savent que leurs recommandations seront souvent ignorées en partie par le décideur. Cette situation de « conformité partielle » aux recommandations soulève plusieurs problèmes de nature philosophique pour les institutions. En nous appuyant sur une analyse de 570 recommandations tirées de 40 documents et rapports du secteur public québécois, nous identifions deux enjeux entourant la structure des recommandations issues (...) du secteur public. Schaffer (2010) argues that the internal relatedness of all things, no matter how it is conceived, entails priority monism. He claims that a sufficiently pervasive internal relation among objects implies the priority of the whole, understood as a concrete object. This paper shows that at least in the case of an internal relatedness of all things conceived in terms of physical intentionality - one way to understand dispositions - priority monism not only doesn't follow but also is precluded. We conclude (...) that the internal relatedness of all things is compatible with several different ontologies (including varieties of pluralism) but entails nothing concerning dependence between concrete objects. We present a module based criterion, i.e. a sufficient condition based on the absolute value of the matrix coefficients, for the convergence of Gauss–Seidel method (GSM) for a square system of linear algebraic equations, the Generalized Line Criterion (GLC). We prove GLC to be the “most general” module based criterion and derive, as GLC corollaries, some previously know and also some new criteria for GSM convergence. Although far more general than the previously known results, the proof of GLC is simpler. (...) La premisa que guía nuestra investigación es que Poética es un tratado científico, i. e., que la investigación desarrollada en dicha obra se corresponde con el examen de una téchne. Defendemos que el método utilizado se corresponde con el método general de investigación denominado “salvar las apariencias”. Tal método es expuesto con más detalle en otras obras del corpus pero lo presuponemos utilizado en Poética. Si bien el método presupone la recolección de datos, no se limita a eso puesto que (...) el paso ulterior consiste en la caracterización de las diferencias y la exposición de las cuatro causas del fenómeno. "A theoretical juice extractor: The role of mathematics in scientific explanation". There have recently been proposed cases where, supposedly, mathematics would play a genuinely explanatory role in science. These have been divided into those situations where the explanatory role would be played by mathematical operations, and those where it would be played by mathematical entities. In this article, I analyze some of these purported cases and argue that claims that mathematics can be genuinely explanatory are unfounded. Throughout my discussion, I (...) emphasize the representational role of mathematics, as opposed to its supposed explanatory role: the role of mathematics, even in the cases that I discuss, is to represent physical facts and help draw inferences about those facts. Inspired by Castañeda (1966, 1968), Perry (1979) and Lewis (1979) showed that a specific variety of singular thoughts, thoughts about oneself “as oneself” – de se thoughts, as Lewis called them – raise special issues, and they advanced rival accounts. Their suggestive examples raise the problem of de se thought – to wit, how to characterize it so as to give an accurate account of the data, tracing its relations to singular thoughts in general. After rehearsing the main tenets of (...) two contrasting accounts – a Lewisian one and a Perrian one – in the first section of this paper, in the second I will present a proposal of my own, which is a specific elaboration of the Perrian account. In the first section I will indicate some weaknesses of Perry’s presentation of his view; the proposal I will articulate in the second overcomes them. I will conclude with a brief discussion of reasons for preferring one or another account, in particular regarding the issue of the communication of de se thoughts. (shrink)

La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. In an attempt to start rectifying a lamentable disparity in scholarship, we evince fruitful points of similarity and difference in the ideas of Simone de Beauvoir and Ayn Rand, paying particular attention to their views on long-term projects. Endorsing what might be called an “Ethic of Resolve,” Rand praises those who undertake sustained goal-directed actions such as careers. Beauvoir, however, endorses an “Ethic of Ambiguity” that makes her more skeptical about the prospects of carrying out lifelong projects without deluding oneself. (...) I discuss an aspect of the relation between accounts of de se thought and the phenomenon of immunity to error through misidentification. I will argue that a deflationary account of the latter—the Simple Account, due to Evans —will not do; a more robust one based on an account of de se thoughts is required. El día dieciséis de julio de este año, un día después de la festividad de san Buenaventura, este santo franciscano, doctor de la Iglesia, recibió un regalo: una de las personas que aquí y ahora más conocía de su obra, pensamiento y fuentes, iba a ir a visitarlo. Ambos tenían, al fin, la oportunidad de conocerse en persona. Para sus amigos fue un regalo muy caro. Nuestro amigo Francisco de Asís Clavero Blanco nos dejó físicamente, pero sus estudios y su (...) obra perdura y perdurará con nosotros.' Decir que alguien conoce a san Buenaventura no es fácil, pues en este pensador franciscano se conjugan aspectos filosóficos, teológicos, históricos y espirituales que llevan en sí una carga histórica compleja que se desarrolla en un tiempo, a la vez, complejo, apasionante y alejado en el tiempo: el siglo XIII. No en vano, la figura de san Buenaventura fue tildada por algunos como "la más medieval de la filosofía del Medioevo".Pero Francisco de Asís Chavero se preparó para afrontar este reto y más. Nacido en Rivera del Fresno en 1945, profesó en la Orden Franciscana en la Provincia Bética el 6 de agosto de 1967. Se ordenó presbítero el 21 de julio de 1973. Cursó filosofía y teología en el Centro de Estudios Teológicos de Sevilla, en la Facultad de Teología de Granada, en el Pontificio Ateneo Antonianum y en el Centro de Investigación de Quarachi de la Orden Franciscana situada en Grottaferrata en Roma. Estos estudios hicieron que quedara corta su titulación de Licenciado en S. Teología, sección Histórico?Dogmática. En el momento en el que le sorprendió la muerte era profesor de Teología Sistemática, Antropología Teológica y Pensamiento Franciscano en el Instituto Franciscano de Murcia.El perfil de su formación, trabajo y dedicación nos ayuda a comprender por qué a Francisco de A. Chavero no se le escapaba ningún detalle del pensamiento bonaventuriano. No había aspecto de su pensamiento filosófico, teológico, espiritual o franciscano que no conociera. Su obra, sus ediciones, las fuentes, los estudios e interpretaciones sobre el doctor Seráfico eran, no sólo conocidas por él, sino también estudiadas, pensadas e interpretadas. De todo lo que acabo de decir dan fe sus escritos y las extensísimas notas a pie de página que nos regalaba. Hablando de su trabajo siempre mostraba la visión de fondo que impregnaban sus estudios: el de historiador de la teología. Esto no significa que desde esta perspectiva histórica no fuera capaz de percibir y apuntar conceptos nuevos y visiones originales.Francisco de Asís Clavero Blanco colaboró en numerosas revistas como Verdad 1, Vida, Carthaginensia, Estudios Franciscanos, Doctor Seraphicus, Themata, Archivum Franciscanum Historicurn, etc. Era miembro de la Sociedad Escotista Internacional , del Centro di Studi Bonaventuriani , Asociación Hispánica de Estudios Franciscanos y compañero de la Sociedad Española de Filosofía Medieval . Me gustaría en estas páginas repasar aunque sea brevemente el legado intelectual de este pensador franciscano. (shrink)

Aristotle’s Politicsis not only famous for its theory of constitutions, but for its statements about human nature. According to the central claim of Aristotle’s political anthropology, man is by nature a political animal (phusei politikon zôon). This famous statement is presented as the conclusion of the first set of arguments that Aristotle develops in the second chapter of book I of the Politics(Pol.,I, 2, 1252a24–1253a3). Aristotle’s statement is inextricably linked with the claim that the polisexists by nature (phusei), which he (...) mentions in the same phrase, as part of his conclusion: “From these considerations it is evident that the polisis one of the things that exist by nature, and that man is by nature a political animal”(Pol.,I, 2, 1253a1–3). Evidently, the claims that the polisexists by nature and that man is by nature a political animal are complementary. This article presents an interpretation of the two complementary claims or theses arguing that in Pol.,I, 2 Aristotle conceives exclusively of human beings as political animals because the whole chapter focuses on theanalysisof the polis,a community peculiar to humans. Italso examines Aristotle’sclaim that the polis“is by nature prior (proteron) to the household and to the individual”(Pol.,I, 2, 1253a18–19). The paperdisagrees withscholars whounderstand this claim as an independent third thesis and theoremand argues that Aristotle’s claim functions as a strong argument for the thesis that man is by nature a political animal. In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. Este artigo contribui para o debate sobre a relação da filosofia prática e teórica de Aristóteles. Ele argumenta que sua filosofia prática depende em grande parte de sua concepção teleológica da natureza. Esta tese é dirigida principalmente contra os estudiosos que sustentam que Aristóteles não deriva de relações políticas e humanas de condições naturais ou cósmicas. O artigo defende a interpretação antropocêntrica de David Sedley da teleologia natural de Aristóteles e mostra como Aristóteles aplica explicações teleológicas às relações de poder (...) entre os seres humanos - entre homens e mulheres e entre homens livres e escravos naturais - e seus propósitos e objetivos. O artigo enfoca o argumento da “função” (ergonomia) humana de Aristóteles, que é um argumento teleológico no centro de sua filosofia prática. Argumenta que este argumento, que Aristóteles apresenta para definir ‘florescimento humano’ ou ‘felicidade’ (eudaimonia), depende de sua definição de homem como o único ‘ser vivo que tem linguagem e razão’ (zôon logon echon). Alega ainda que a disputa sobre se Aristóteles identifica eudaimonia apenas com uma vida de contemplação ou se eudaimonia inclui uma vida política pode ser esclarecida referindo-se ao propósito natural dos logotipos. Cet article poursuit la réflexion de Dilhac (2014) touchant la relation entre politique et vérité. Au terme d’une analyse de la tolérance chez Mill et Popper, Dilhac conclut qu’une conception épistémique de la tolérance manque sa dimension politique, et qu’il est préférable d’opter pour le concept rawlsien de consensus raisonnable. Discutant ces résultats, le premier objectif est ici de montrer qu’une notion de « raisonnabilité » peut facilement trouver ses racines dans la neutralité scientifique wébérienne, et donc être porteuse d’une (...) dimension épistémique minimale. Le second objectif est de clarifier l’impact de cet argument particulier sur le débat général entourant la démocratie épistémique. Il sera défendu que l’opposition traditionnelle entre les conceptions épistémique et politique de la délibération est à trouver dans un certain perfectionnisme épistémique, mais qu’il existe au moins une conception minimale du potentiel épistémique tout à fait compatible avec les valeurs fondamentales du libéralisme, comme l’inclusion, l’égalité ou la diversité. En d’autres termes, les exigences épistémiques minimales de la neutralité scientifique peuvent être indépendantes du perfectionnisme épistémique. (shrink)

L’objectif de cet article est double. D’une part, il vise à identifier une interprétation éthique de la neutralité axiologique, et non de réduire ce critère à des considérations épistémologiques comme la distinction entre faits et valeurs. On peut, en effet, interpréter le critère de neutralité axiologique comme un mécanisme visant à défendre l’autonomie des différents membres de la communauté universitaire. D’autre part, cet article entend utiliser cette interprétation éthique pour répondre aux critiques contemporaines de la neutralité axiologique. Amartya Sen et (...) Hilary Putnam ont proposé des critiques pertinentes de la neutralité axiologique, en réfléchissant sur les conditions d’objectivité du discours éthique et politique. Au terme de cette analyse, nous proposerons une conception publique de la science, qui répond à l’impératif éthique de neutralité en sciences sociales, ainsi qu’au programme de recherche amorcé par Sen et Putnam. L’examen critique et public de la science est ce qui permet de respecter tant l’exigence de neutralité chez Weber que la demande d’une science renouvelée chez Sen et Putnam. (shrink)

Cet article a deux objectifs. Le premier est de montrer pourquoi l’argument instrumental en faveur de la démocratie est insuffisant pour justifier la délibération politique. Si notre but est l’optimisation du potentiel épistémique d’un régime politique, et que des approches agrégatives et inférentielles (sans délibération) atteignent cet objectif, alors nous ne pouvons plus justifier la délibération sur cette base. Ce problème peut être contourné en reprenant une distinction de Daniel Andler. Pour ce dernier, le groupe délibératif se distingue du groupe (...) agrégatif parce qu’il permet aux agents, par une occasion éducative informelle, de se responsabiliser. La délibération présente donc un potentiel épistémique supérieur, mais qui ne se limite pas à identifier la meilleure réponse dans un temps donné. Le second objectif de l’article est de montrer comme l’argument d’Andler fait le pont entre, d’une part, les théories de la justification publique et, d’autre part, les théories de la démocratie épistémique. El estudio actual de la argumentación se encuentra distanciado de la lógica. En este artículo sostengo que restaurar el vínculo del estudio de la argumentación con esta disciplina podría resultar benéfico para la metas descriptivas y normativas de este campo de investigación. Tras destacar algunos aspectos del surgimiento la teoría de la argumentación contemporánea, enfatizando la idea de "perspectivas", explico cómo el reconocimiento de sus objetivos y tareas volvió problemática la coexistencia de varios enfoques o aproximaciones para el estudio de (...) la realidad argumentativa. Sugiero algunas hipótesis explicativas sobre el abandono del enfoque lógico en favor de otras alternativas y, a continuación, ofrezco razones para encauzar el estudio sistemático de la argumentación desde este enfoque. Además de las consideraciones normativas y las herramientas descriptivas que pueden aducirse en su favor, sostengo que el enfoque lógico puede proporcionar una clase de integración a este campo investigación de maneras que no están disponibles para otras aproximaciones. Aristóteles establece los principios de la generación en GC 1 pero en adelante construye genuinas demostraciones científicas apoyándose precisamente en aquellos principios. Reconstruiremos un pasaje puntual de GC 2. 10 para defender la hipótesis del uso real de la demostración científica en los tratados científicos. La particularidad específica de este trabajo es que esta demostración científica apunta a hacer explícita, (...) dentro del marco de la cuádruple causalidad aristotélica, la causalidad eficiente del fenómeno de la generación. In this paper I argue that the idea of human dignity has a precise and philosophically relevant sense. Following recent works,we can find some important clues in the long history of the term.Traditionally, dignity conveys the idea of a high and honourable position in a hierarchical order, either in society or in nature. At first glance, nothing may seem more contrary to the contemporary conception of human dignity, especially in regard to human rights.However,an account of dignity as high rank provides (...) an illuminating perspective on the role it plays in the egalitarian discourse of human rights. In order to preserve that relational sense regarding human dignity, we can use the notion of moral status, towhich somemoral philosophers have paid attention in recent years.I explore the possibilities of the idea of moral status to better understand the idea of human dignity and its close relationship with human rights. Algunos presupuestos teológicos de la crisis de Occidente Some theological presuppositions of the crisis of the West -/- Manuel Ocampo Ponce Universidad Panamericana Departamento de Humanidades -/- Resumen. Muchos hablan de una crisis en occidente y de los distintos factores que han contribuido a la misma. Sin embargo, no son tantos los que involucran los factores teológicos que han influido en dicha crisis. Se trata de presentar ciertas ideas filosóficas que han repercutido en las propuestas de algunos teólogos y pensadores del siglo XX y lo que va del XXI, y de demostrar que dichas ideas han producido cambios significativos en la concepción de Dios, en la concepción de las dimensiones personal y social del hombre, y con estas en la organización del mundo contribuyendo, en distintos niveles, lo que se ha denominado la crisis de Occidente. -/- Palabras clave: Dios, Cristianismo, ser, Teología, Metafísica, crisis, agnosticismo, relativismo, secularismo. -/- Abstract. Many speak of a crisis in the West and of the various factors that have contributed to it. However, few mention the theological factors that have influenced this crisis. Hence, the present study is an attempt to present some of the theological presuppositions of what has been called "the crisis of the West". The study presents certain philosophical ideas that have had repercussions on the proposals of some representative theologians of the twentieth and twenty-first centuries. It seeks to demonstrate that these ideas have produced some changes in the conception of God, in the conception of personal and social dimensions and in the organization of the world. These have favored, at different levels, what has been called the crisis of the West. -/- Key words: God, Christianism, being, Theology, Methaphisics, crisis, agnosticism, relativism, secularism. -/- En las últimas décadas se ha hablado mucho de que el mundo occidental se encuentra en crisis. Crisis de pensamiento, crisis de valores, crisis moral, crisis en los ámbitos científicos, artísticos, humanos, ambientales, etc. Sin embargo, es necesario aclarar que, para comprender Occidente y su crisis, es imprescindible considerar el papel del cristianismo como elemento fundamental de la cultura occidental. No podemos dejar de lado que, si el cristianismo tiene un peso en el desarrollo de Occidente, también debe tener un peso en sus logros y en sus decadencias y fracasos. En efecto, así como no podemos entender el mundo árabe si no conocemos el Islam, o Asia si no conocemos el budismo, tampoco podemos comprender Occidente si no conocemos el cristianismo. Esa es la razón por la que pensamos que cualquier análisis serio de la cultura de Occidente, ha de considerar el cristianismo como elemento clave para su comprensión. Pero hay que ser conscientes de que el cristianismo abarca muchos ámbitos especulativos y prácticos que, en una investigación de esta naturaleza, son imposibles de abarcar. Por lo mismo, el presente estudio se limita a mostrar de manera muy panorámica sólo algunos de los elementos teológicos de la crisis de Occidente que muchas veces son pasados por alto en distintos ámbitos, considerando que la Teología cristiana está conformada por una fuerte base filosófica. Como corolario de este estudio se deduce una solución que deviene de los mismos factores que han sido causas de la crisis. Se ha realizado una selección de algunos autores que he considerado como representativos de movimientos de pensamiento que han dado lugar a ciertos cambios importantes, y presentarlos demostrando el papel que ha tenido la modificación de la Teología cristiana en la crisis de Occidente. O presente trabalho pretende, sobretudo, relevar o poder argumentative do orador, seguindo de perto as considerações de Chaïm Perelman sobre a Retórica como "discurso que visa convencer ou persuadir". Simultaneamente, desta-cam-se os голоl ou valores universais patenteados no texto de Vieira e que constituem a base da (...) teoria da argumentação de Oswald Ducrot. \\\ In the "Sermon for the good success of the Portuguese army against Holland's", Vieira displays all his gifts as an uncommon writer, an excellent theologian, a non negligeable jurist, a convinced humanist, and, above all, a wholehearted patriot. This essay is an attempt to put in evidence the preacher's argumentative power, on the basis of Chaïm Perelman's considerations on Rethoric as "a speech that aims to convince or persuade". At the same time, we emphasize, as displayed in Vieira's text, the "topoi", or universal values, that are the basis of Oswald Ducrot's argumentation theory. (shrink)

En oposición a tales interpretaciones, este ensayo defiende la (...) tesis que Aristóteles pertenece a la tradición de pensamiento político aristocrático. Esta tradición se remonta a Teognis, Heráclito y Platón y se inicia como una crítica dirigida tanto a la decadencia de la virtud aristocrática como cuanto al ascenso de valores democráticos ey egalitariosigualitarios. Este ensayo trabajo demuestra que Aristóteles concibe las diferentes formas de constitución como manifestaciones de distintas concepciones de la justicia distributiva. Aristóteles mantiene una clara preferencia por una concepción aristocrática de la justicia, y , por tantocomo consecuencia, por la aristocracia. La constitución de la mejor polis ideal que detalla en los libros VII y VIII de la Política debe entenderse como una “verdadera aristocracia” en la que los cargos políticos son distribuidos, según el mérito (κατ᾽ ἀξίαν), a los mejores ciudadanos entre los ciudadanos que sean los mejores desde el punto de vista moral e intelectualtanto moral como intelectualmente hablando. Descartes held that it is impossible to make true statements about what we perceive, but I go over alleged cases of illusory experience to show why such a skeptical conclusion (and recourse to God) is overblown. The overreaction, I contend, stems from an insufficient awareness of the habitual expectations brought to any given experience. These expectations manifest themselves in motor terms, as perception constantly prompts and updates an embodied posture of readiness for what might come next. Such habitual anticipations work (...) best when they efface themselves, so it is easy to blame perception when our expectations get frustrated. I illustrate this misdirected blame with the example of a stick partially in water: it is only because we expect the stick to be straight that its appearance as bent is deemed problematic. I thus conclude that, if we factor in the habitual interpretations operative in perception and switch to a processual view that allows practical engagement, we can deflate the worries that led Descartes to rule out perceptual truths. Distancing myself from the naïve “sign” of folk semiotics, my critique draws inspiration from the triadic semiotic model developed in some late medieval schools of Portugal. (shrink)

La obra de Lévinas propone asumir la ética como Filosofía Primera. Allí convergen dos fuentes de inspiración filosófica, el pensamiento judío y la fenomenología, y la experiencia histórica de persecución, violencia y desconocimiento del otro que exigió a Lévinas criticar el totalitarismo ontológico griego con el propósito de hacer justicia a la Alteridad y dar primacía así a la Responsabilidad para con el Otro sobre la Libertad autónoma del Yo. Luego, el autor retorna la crítica de Lévinas a la fenomenología (...) de la conciencia y a la ontología hermenéutica de Heidegger, con la que Occidente lleva a término su limitada opción por el conocimiento y la manifestación del Ser. Rubio y Lévinas, en tercer lugar, señalan hacia una hermenéutica encarnada de nuestras relaciones con el Otro, a una reivindicación de la antropología filosófica que recupere el Sentido desde el Otro. Finalmente, el autor se refiere al terna de la muerte en Lévinas, y subraya, en relación con la desaparición del maestro Rubio que, nuestro adiós a él, significa el 'ante Dios' de todas nuestras relaciones no tematizables con el Otro y antes que todo. Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. “Structuralism, Fictionalism, and the Applicability of Mathematics in Science”. This article has two objectives. The first one is to review some of the most important questions in the contemporary philosophy of mathematics: What is the nature of mathematical objects? How do we acquire knowledge about these objects? Should mathematical statements be interpreted differently than ordinary ones? And, finally, how can we explain the applicability of mathematics in science? The debate that guides these reflections is the one between mathematical realism and (...) anti-realism. On the other hand, the second objective is to discuss the arguments that use the applicability of mathematics in science to justify mathematical realism, and show that none of them reaches its aim. To this end, we will distinguish three aspects of the problem of the applicability of mathematics: the utility of mathematics in science, the unexpected utility of some mathematical theories, and the apparent indispensability of mathematics in our best scientific theories - in particular, in our best scientific explanations. Finally, I argue that none of these aspects constitutes a reason to adopt mathematical realism. (shrink)

Discuto en este trabajo el adecuado tratamiento de un interesante problema semántico, largamente tratado por David Kaplan (1973). El problema fue propuesto originalmente por Richard Cartwright. Después de exponerlo, presento y comento cuatro soluciones. Las soluciones proceden del trabajo de Kaplan; me he tomado no obstante algunas licencias en su presentación. Paso después a proponer una nueva solución al problema de Cartwright, en consonancia con puntos de vista, hasta cierto punto contradictorios con los de Kaplan, que he venido defendiendo en (...) trabajos previos sobre la semántica de indéxicos y nombres propios. El objetivo principal que el trabajo persigue es ofrecer una confirmación indirecta para tales puntos de vista, en tanto que sobre la base teórica que nos proporcionan podemos ofrecer una solución a la paradoja de Cartwright más satisfactoria que las otras hasta ahora propuestas. En la literatura jurídico penal, el arrepentimiento cobra relevancia en un lugar específico: la condena, más precisamente, en la determinación de la pena del sujeto que ha sido encontrado responsable por la comisión de un delito y que, a su vez, se encuentra arrepentido por su accionar. Desde la concepción comunicativa del castigo, en este trabajo contestaré las siguientes preguntas: ¿El arrepentimiento significa un menor reproche penal o es indiferente para la determinación de la pena? en caso de que implique (...) un acercamiento al castigo mínimo establecido en la legislación ¿Cuándo es razonable que esto suceda? Dieser Beitrag greift das Phänomen Fake News auf und plädiert für einen analytischen Zugang zur Thematik. Zunächst grenzt er den Begriff der Fake News von anderen Phänomenen ab. Er zeigt auf, dass der Begriff nicht nur keinen analytischen Mehrwert bietet, sondern dass er die eigentlichen Probleme verschleiert und als Propagandabegriff u.a. Verwendung findet, um Zensur zu rechtfertigen und die Gegenseite zu delegitimieren. Trotzdem sollte die Politische Bildung nicht vollkommen auf den Begriff verzichten. Versteht man Fake News als einen fließenden Signifikant (...) in hegemonischen Projekten, erlaubt dies den Zugriff auf die politische Dimension von Desinformation. Fake News als politischer Kampfbegriff lässt sich darüber hinaus als einen Angriff auf die Autorität der Leitmedien interpretieren. Der Autor geht im Anschluss sowohl auf die inhaltliche als auch auf die formelle Dimension dieses Angriffs ein. Darauf basierend erarbeitet er einen Vorschlag, wie Fake News auf analytischer Basis in der Politischen Bildung behandelt werden könnten. (shrink)

Reposant la question de la structure logique de la modalite chez Kuki, cette etude vise a mettre en evidence les multiples dimensions du temps humain. Une telle meditation s’accompagne d’une reflexion sur le ≪ vecu ≫ de la vie concrete dont Kuki fournit une elucidation que l’on pourrait qualifier de metaphysique. Cette metaphysique de la vie est a rapprocher de la pensee de l’Instant tel que Kierkegaard le pense, de la temporalisation heideggerienne et de la duree chez Bergson. Mais le (...) philosophe le plus important convoque par Kuki reste Nietzsche dont la pensee fulgurante de l’eternel retour du meme nourrit la categorie de la contingence de l’existence. Sauf que precisement, la contingence ne peut pas etre une categorie. La philosophie nietzscheenne traverse et nourrit l’oeuvre de Kuki. La presente etude a pour ambition de laisser se confronter la pensee du retour et le temps de la duree. C’est dire qu’il est question ici de reflexion metaphysique sur cette dimension fondamentale de la conscience qu’est la forme du sens interne. Utiliser cette notion c’est eo ipso faire reference a Kant. Quels sont les rapports de ces multiples temporalites avec le temps eternel des dieux et du destin, telle est la question que souleve l’opus magnum de Kuki. Nous montrons les articulations d’abord logico-metaphysiques, ensuite existentiales de la structure de l’existant. C’est le raffinement esthetique de l’aristocrate qu’etait Kuki qui a nourri notre essai de penser et de comprendre la structure de l’Iki. (shrink)

La neutralité axiologique est souvent présentée comme une vertu professorale, ou comme une composante essentielle d'une déontologie de l'enseignement. Nous mettons cette conception de la neutralité axiologique à l'épreuve, notamment parce qu'elle ne permet pas d'expliquer 1) l'importance d'un enseignement diversifié, 2) l'importance, pour les personnes subissant une influence illégitime, d'avoir des recours institutionnels, et 3) l'importance qui devrait être accordée par l'Université à l'autonomie des étudiant-e-s. Pour ces raisons, nous proposons plutôt d'interpréter la neutralité axiologique comme une exigence institutionnelle, (...) exigence compatible avec une certaine tradition de la liberté académique. En décadas recientes se ha considerado que una formulación adecuada del autoconocimiento (AC) debería ser consistente con la tesis del externalismo (E). Michael McKinsey es uno de los personajes que ha enfatizado con mayor ahínco que la conjunción de ambas posturas es inconsistente. En este trabajo defiendo la idea de que las objeciones presentadas por McKinsey no afectan de manera importante la formulación davidsoniana de la autoridad de la primera persona (AC3) en conjunción con (E); señalo, además, que si no (...) pudiera hacerse una reconstrucción à la Davidson de (AC3) desde la postura de McKinsey sería en virtud de las diferencias metodológicas, semánticas, epistemológicas y ontológicas entre ambos autores, y no debido a que esta reconstrucción en sí misma sea incompatible con el externalismo. En el pensamiento de Santo Tomás de Aquino, la Filosofía Moral y la Teología Moral tienen al bien como concepto central, es decir, el ser en cuanto apetecible y en cuanto fin de la tendencia o apetito. Lo anterior es debido a que lo bueno expresa el en cuanto se relaciona con el apetito y de este modo señala la capacidad del ser para mover la voluntad o una tendencia cualquiera hacia su fin. Es por esto que Santo Tomás sostiene (...) con Aristóteles que el bien coincide con la noción de fin. Y es por la importancia de estos principios y por la repercusión en la moral y sobretodo en la explicación de la libertad moral, que este breve trabajo consiste en una profundización en las relaciones entre el bien, el fin y la naturaleza y algunas de sus aplicaciones a lo que se conoce como tendencia natural o apetito natural y la tendencia libre que se refiere a la voluntad sobre todo a la voluntad de la persona humana. No se trata de un intento por presentar todas las conclusiones que de estos principios se siguen, lo cual correspondería a la Filosofía o a la Teología Moral, sino más bien de una profundización en los principios metafísicos, para asentar los cimientos del orden moral. -/- In the thought of St. Thomas Aquinas, both ethics and moral theology have as their central concept of the good, that is, of being insofar as it is desirable and insofar as it is the end of appetitive tendencies. This is due to the fact that the good expresses being insofar as it relates to the appetite, and thus it expresses the capacity of being to move the will, or to any tendency towards its end. For this reason St. Thomas holds with Aristotle that the good is convertible with the notion of end. And it is due tuo the importance of these principles and their consequences for morality and moral freedom that in this brief work I attempt to delve into the relationship between the good, the end, and nature, and some of its applications to what is known as natural tendency or natural appetite as well as to the free tendency which is called "the will", especially the will of the huma person. It is not an attempt to present all the conclusions that follow form these principles -a task that would correspond to ethics or to moral theology- but attempt to delve into the metaphysical principles that ground the moral order. Pourquoi accorder un rôle essentiel à la délibération publique dans le choix des normes éthiques et politiques guidant les sciences? À partir d’un débat récent en économie du bien-être, cet article soutient que l’introduction de normes éthiques et politiques en sciences doit respecter le principe de neutralité procédurale, et qu’une délibération publique bien encadrée respecte ce principe. Je présenterai deux raisons de croire que les sciences doivent respecter la neutralité procédurale. Le premier argument est lié au rôle que devrait jouer (...) l’examen libre et critique dans le développement des sciences. Le second argument repose sur l’idée que les sciences devraient être sensibles aux procédures présentant le meilleur potentiel épistémique. Pour ces deux raisons, si elle prend position en faveur d’idéaux normatifs, l’économie du bien-être devrait se tourner vers une approche délibérative, rationnelle et impartiale pour y parvenir. It is common to criticize the idea of objectivity by claiming that we cannot make sense of any cognitive contact with the world that is not constituted by the very materials of our thinking, and to conclude that the idea must be abandoned and that the world is ‘well lost’. We resist this conclusion and argue for a notion of objectivity that places its source within the domain of thoughts by proposing a conception of facts, akin to McDowell’s, as thinkable (...) while independent of any act of thinking. Die Forschung hat bislang entweder bemängelt, dass Nietzsches Philosophie ein Begriff von szialer Gerechtigkeit fehlt oder had einen solchen kaum in den Blick bekommen. Im Gegensatz dazu argumentiert der Aufsatz dafür, dass der sozialen Gerechtigkeit in Nietzsches politischem Denken eine zentrale Rolle zukommt. Er zeigt, dass das antike Vorbild seiner Gerechtigkeitsauffasseng Platons Begriff der politischen Gerechrigkeit ist. Die Kernthese des Aufsatzes ist, dass diese Gerechtigkeitsauffassung in Nietzsches Konzeption einer guten Ordnung des Staates und der Gesellschaft enthalten oder verkörpert ist. eine (...) weitere These betrifft das anthropologische Fundament von Nietzsches Vision einer gerechten Gesellschaftsordnung. Dieses Fundament bildet seine Grundüberzegung, dass die Menschen nicht bloß fundamental ungleich sind, sondern dass ihnen auch ein äußerst ungleicher Wert und Rang zukommt.Up to now researchers have maintained that Nietzsche's philosophy has no concept of social justice or have hardly noticed such a concept. On the contrary, the essay argues that social justice plays an important role in Nietzsche's political thinking. It shows that his conception of justice is modelled after Plato's antique concept of political justice. The main thesis of the essay is that this conception is embodied in Nietzsche's notion of a well-ordered state or society. An additional thesis concerns the anthropological basis of what Nietzsche holds to be a just social order. This basis is constituted by his conviction that people are not only fundamentally unequal but also extremely different in worth and rank. (shrink)
